Hillside Township Ordinances
The
following is a list of ordinances commonly enforced by the Hillside
Police Department. For a complete list please contact the Township
clerk's office at (973) 926-3000.
§
291-18.1. Permit
parking
A.
Parking on certain streets limited to residents and guests. Except as
otherwise provided within this section, no person shall park a vehicle
upon any of the following streets unless that person is a resident or
guest of a resident of the Township of Hillside and displays a valid
residential parking permit or guest parking permit.

B. Residential parking permit
requirements.
(1) Residents of any street
enumerated in Subsection A shall be entitled to residential parking
permits not to exceed the limits set forth above. Said permits
shall be issued annually by the Chief of Police and shall expire on
December 31 of the calendar year of issue.
(2) Residential parking permits for
the Bailey Avenue Municipal Lot will be available to residents of
the immediate area only. A limit on the number of permits available
for this area may be imposed by the Chief of Police. All
residential parking permits are issued on a first come, first served
basis. Residents without access to a private driveway or other
off-street parking shall have priority; however, the issuance of a
permit does not guarantee a parking space except that vehicles
without a permit shall not park in this lot.
(3) Residential parking and guest
permits shall be for the exclusive use and convenience of Hillside
residents, and their guests, and shall not be transferable or used
by other persons.
(4) Any resident who shall apply for
a parking permit as provided by this section shall present to the
Chief of Police or his designee the following documents which shall
demonstrate proof of residency:
(a) New Jersey driver's license.
(b) New Jersey Vehicle Registration
and Insurance Card.
(c) Permit fee as required by
Subsection C of this section.
(5) Parking permits shall be
prominently displayed in the manner prescribed by the Chief of
Police on vehicles while parked in the locations enumerated in
Subsection A of this section.
C. Guest permits.
(1) Guest permits shall be available
for the use and convenience of any guest of a household located on a
street/location enumerated in Subsection A and shall be transferable
from vehicle to vehicle. At no time shall a guest permit be
displayed on a vehicle owned by or registered to a resident or
household member.
(2) The Chief of Police shall
establish a convenient procedure for residents to obtain guest
permits. Said procedure shall not require residents to provide the
name, address or other information that would identify their guest(s)
to any person; however, all guest permits shall be numbered and
prominently displayed in a manner prescribed by the Chief of Police.
(3) Nothing contained herein shall be
construed to limit the number of guests a resident may invite or
suffer in his or her household at any time.
(4) Regular guest permits (reusable).
(a) Residents of the
streets/locations enumerated in Subsection A shall be entitled to
obtain not more than one regular guest parking permit per
household per year.
(b) Regular guest parking permits
shall be issued annually by the Chief of Police and shall expire
on December 31 of the year issued.
(5) Temporary guest permits (nonreusable).
(a) Temporary guest parking permits
shall be available to residents and members of their households at
a cost of $1 per permit and shall be valid for not more than 72
hours. Unless otherwise approved by the Chief of Police or his
designee, no resident or household shall be eligible to receive
more than three temporary guest permits in a seventy-two-hour
period.
(b) The Chief of Police shall be
authorized to deny or rescind temporary guest parking permits as
necessary to keep the peace, prevent crime, facilitate the
unrestricted flow of traffic in the Township or for other good
cause.
D. Permit fees; exemptions.
(1) The following fees for parking
permits shall become effective on January 1, 2008 or as soon
thereafter as this revised Ordinance shall become effective:

(2) The above fees shall be applied
toward the cost of signs, placards and other miscellaneous materials
and expenses associated with the administration of this section.
(3) With the exception of the fees
required for temporary guest permits, the above fees shall not apply
to households wherein any member of the household is a member of the
Armed Forces of the United States of America or the militia of the
State of New Jersey, including but not limited to members of the
United States Army, Air Force, Navy, Marines, Coast Guard, or the
New Jersey National Guard or Air National Guard. This fee exemption
shall also be applicable to members of the Armed Forces who are on
inactive or reserve status, and to honorably discharged members of
the Armed Forces of the United States who present proof of same
along with their application for a parking permit.
(4) Active members of the Township of
Hillside Auxiliary Police Department and Volunteer Fire Department
shall also be exempt from the above fees.
E. Exceptions to permit requirement.
Nothing in this section shall be applicable to the following vehicles:
(1) Emergency vehicles including but
not limited to police, fire and ambulance;
(2) Vehicles engaged in the delivery
of any public works services, including but not limited to street
cleaning, leaf collection, snow removal, garbage removal or other
essential services;
(3) Clearly marked vehicles owned or
operated by a public utility service (electric, gas, cable TV,
etc.), provided said vehicle is used in connection with the delivery
of service to a Township business or resident and does not block or
impede the flow of other parked and moving vehicles,;
(4) United States Postal Service
vehicles or any vehicle used by U.S. Postal Service employees who
are engaged in the delivery of the United States Mail, provided said
vehicle is clearly identified;
(5) Vehicles used by health care
professionals including doctors, visiting nurses, private ambulance
services, pharmaceutical services or other vehicles used in
connection with the delivery of any health care service, medicine or
physical rehabilitation equipment while engaged in the actual
delivery of professional services, medicines or equipment to a
resident or occupant of any building located on the
streets/locations enumerated in Subsection A, where there is
insufficient space or it is otherwise not feasible to park said
vehicle in a private driveway or other suitable off-street parking
area;
(6) Service vehicles clearly marked
and displaying commercial license plates used in connection with the
construction, repair or maintenance, including lawn and garden
maintenance, of a residence or other property located on any
street/location enumerated in Subsection A where there is
insufficient space or it is otherwise not feasible to park said
vehicle in a private driveway or other off-street parking area and
does not block or impede the flow of other parked and moving
vehicles;
(7) Vehicles used in connection with
the delivery of any merchandise, goods or services to residents of
the streets/locations enumerated in Subsection A, provided said
vehicle is clearly marked, displays commercial license plates, is
parked for a period of time not to exceed the time necessary to
accomplish the delivery and does not block or impede the flow of
other parked and moving vehicles,;
(8) Vehicles owned and/or operated by
employees of New Jersey Transit while engaged in any public
transportation service;
(9) Limousines, taxicabs, buses and
other private coaches hired by a resident or guest of a resident of
any street/location enumerated in Subsection A, provided said
vehicle is parked for not more than 15 minutes, does not block or
impede the flow of other parked and moving vehicles, and the
operator remains with the vehicle; and
(10)Any vehicle that displays a valid
handicapped parking permit or handicapped license plates issued by
the Director of the New Jersey Division of Motor Vehicles or a
temporary handicapped parking placard issued by the Chief of Police
of any municipality or other political subdivision in the State of
New Jersey.
§ 124-3. Numbers to appear on each building.

A.
All public and privately owned buildings, including but not limited to
single- and multifamily residences, commercial and industrial
structures, restaurants, offices, schools, houses of worship and all
other facilities now or hereafter erected within the Township shall
bear in numeric figures the street number assigned to the building of
the Tax Map of the Township. Such numeric figures shall be securely
affixed by the owner or occupant to the front of the building and
shall be clearly visible to persons passing by the structure or
premises on the abutting street.
B.
Numeric figures displayed in accordance with this chapter shall also
meet the following specifications:
(1)
Location. Numeric figures must be placed within 10 feet of the front
entrance of the building.
(2) Height. Numeric figures shall be at least four inches in height.
(3) Color. Numeric figures shall be reflective or painted in color(s)
that contrast with the surface to which they are affixed.
(4) Visibility. Numeric figures shall not be obscured by shrubbery or
other landscaping, screens, storm doors, mailboxes, electrical
fixtures, signs, or any other object that would impair their
visibility from the street. In addition, no other numeric figures
shall be placed upon the building next to, within or near the area
upon which the street number is affixed in a manner which would
substantially diminish the visibility or clarity of the street number.
C.
The display of alphabetic, lettered or Roman style numerals is
prohibited unless displayed in addition to and in accordance with the
above requirements.
Alarm Systems
§
106-6a and
106-6b. Registration; Permits.
A.
Any person who owns or operated a police alarm device or a local alarm
shall make written application for the continuance thereof to the
Police Chief, which application shall contain at least the location of
the device, the name of the installer of the device the type of
device, provisions relating to false alarms and testing procedures, a
list of persons to be contacted in the event of an alarm and other
information as may be required by the Township Council.
B. [Amended
3-7-1995; 3-17-1998] Local alarms shall be registered providing such
information and on such forms as the Police Department shall require;
and
(1) In the case of
alarms in residential structures, a one-time registration fee of $10
shall be paid to the Township of Hillside contemporaneous with such
registration by the owner or occupant and by each subsequent owner or
occupant of such residence; or
(2) In the case of
alarms in commercial or industrial structures, a registration fee of
$35 shall be paid to the Township of Hillside contemporaneous with
such registration by the owner or occupant and by each subsequent
owner or occupant of such commercial or industrial structure and
annually thereafter on the anniversary date of such registration for
so long as such structure maintains an alarm.

106-8c.
General regulations; false alarms.
C.
In the case of a false alarm, any person having knowledge of the same
shall immediately notify the Police Department. In addition, in the
case of a false alarm, the Police Chief shall cause an investigation
to be made and keep a record of such alarms. For such alarms that are
determined to be of a false nature, the Mayor, through the Hillside
Police Department, shall cause the following action to be taken
against the alarm owner/user:
(1)
In the event of the occurrence of three false alarms in any calendar
year, the alarm user shall, within three working days after notice to
do so, complete a written report to the Police Chief setting forth the
cause of the false alarm, if known; the corrective action taken;
whether the alarm system has been inspected by an alarm service
company; and any such other information and the Chief of Police may
reasonably require.
(2)
A warning shall be given upon the occurrence of a third false alarm in
any calendar year by the Police Chief or his representative.
(3)
For the fourth false alarm in any calendar year, an assessment of $75
shall be imposed against the alarm user and shall thereupon be payable
to the Township of Hillside.
(4)
For the fifth and all subsequent false alarm(s) in any calendar year,
an assessment of $100 shall be imposed against the alarm user and
shall thereupon be payable to the Township of Hillside.
(5)
In addition to the assessed fees provided in § 106-8c of Chapter 106
of the Revised General Ordinances of the Township of Hillside, 1971,
if the fourth false alarm, or any succeeding false alarm, has resulted
from a failure on the part of the alarm user to take the necessary
corrective action after notification by the Police Department, the
Police Chief may order such alarm user to disconnect such audible
alarm or alarm system. Written notice of such an order shall be served
on the alarm user who shall disconnect the system forthwith. An order
may not be served upon a user whose system is required by law to be
maintained.
Parking
§
11-5A Overnight Parking of Trucks
and/or Buses
(1) No person
shall park the following vehicles overnight on any public street or
municipal property in the Township of
Hillside:
-
Any tractor truck cabs with or without trailers
attached; or any trailer or combination of trailer(s) incapable of
being moved on its or their own power.
-
Pick up trucks, vans or trucks or any type of commercial
markings.
-
Trucks or any type
loaded or equipped in a manner that would lead a reasonable observer
to believe that same was being used for commercial or industrial
purposes.
-
Buses of any type.
-
Jitneys and taxi cabs.
(2)
Overnight parking for the purposes of this ordinance shall mean and
include parking after 11:00pm and before 6:00am of any day.
(3) (i) Any person, association or corporation who
shall violate the provisions of this ordinance shall, upon conviction,
be subject to a fine of not less than $100.00 nor more than $500.00,
or imprisonment for a period not to exceed thirty (30) days, or both,
at the discretion of the court.
(ii) In addition to the above penalties set
forth in subsection (3) (i) of this section of this ordinance, the
Township Police Department, after the issuance of a second summons
involving the same vehicle within a thirty (30) day period, may cause
such vehicle to be towed or otherwise removed from the public street
or municipal property, with the owner of such vehicle being
responsible for the cost of such removal.
(4) The provisions of this ordinance shall not apply
to vehicles owned by a public utility, as defined in N.J.S. 48:2-13,
when such vehicles are being used for work in connection with the
furnishing or supplying of the commodity which by law the public
utility is authorized to furnish or supply.
2.
Section 2. All ordinances or parts of ordinances inconsistent
herewith are hereby accordingly repealed to the extent of any such
inconsistency.
3.
Section 3. This ordinance shall take effect twenty (20) days after
final passage by the Township Council and approval by the Mayor, and
according to law.

11.3.7 Snow Emergency Routes
Parking Prohibited Temporarily on Certain Streets for Snow Plowing and
Snow Removal. Whenever snow has fallen and the accumulation is such
that it covers the street or highway, no vehicle shall be parked or
permitted to be parked, or allowed to be parked on any of the streets
or parts of streets described in Schedule V (listed below).
Any unoccupied vehicle parked or standing in violation of this
section shall be deemed a nuisance and a menace to the safe and proper
regulation of traffic and any peace officer may provide for the
removal of such vehicle. The owner shall pay the reasonable costs of
the removal of and storage which may result from such removal before
regaining possession of the vehicle.
The effectiveness of this section is contingent on signs being
erected as required by law.
